Fitsemons Road Maintenance Case

Fox Law, APC Resolves a Road Maintenance Case Against the County of San Diego for $2,500,000

Fox Law, APC represented Timothy Fitsemons, a 29 year-old rescue swimmer for the United States Navy.  On July 10, 2013, Tim went for a ride on his motorcycle on State Route 94 near Jamul, California and hit a dangerous dip in the road.   He fell from his bike and suffered various injuries, including fractures to his scapula, clavicle, and back.  The damage to his spinal cord leaves him with diminished sensation in his legs, and makes it difficult for him to walk for long distances.   The County maintained Tim was riding too fast for the conditions; however, it repaired the condition after Tim’s incident.  Tim had to retire from the Navy and so this result will truly help him going forward.  The attached video gives a peek into Tim’s life and his tremendous recovery.  Fox Law and Tim would like to thank some other attorneys that advised and assisted the firm on this case, including John Gomez, Russ Gold, and Benjamin Bunn.

Dave Fox, Esq is the principal of Fox Law, APC, a Del Mar and North County San Diego injury and car accident law firm. The attorneys practice personal injury and civil litigation throughout the state of California and are dedicated to helping ordinary individuals receive extraordinary results.
