The Maui Fires: Legal Representation for Wildfire Victims

Cause of the Maui Fires.  Available evidence points to powerlines downed by high winds. The National Weather Service predicted wind speeds driven by Hurricane Dora as high as 60 miles per hour combined with warm temperatures and dry conditions that primed Hawai’i for increased fire danger and rapid fire spread.

Videos taken across the island show powerlines falling due to poor maintenance and high wind conditions.  Those lines  ignited the vegetation below.  Hawaiian Electric’s 60,000 power poles, most made of wood, were described in the company’s own documents as built to “an obsolete 1960s standard”. Power lines across the island were nowhere near meeting a 2002 national standard to withstand 105-mile-per-hour winds, nor were surrounding trees and vegetation properly managed.

The Marshall Fire Litigation
The Marshall Fire ignited on December 30, 2021, and swept through the City of Louisville, Town of Superior, and unincorporated Boulder County. Prior to being contained, it destroyed and damaged more than 1,000 homes and over 30 commercial structures.  We actively represent more than 500 individuals impacted by the Marshall Fire in on-going litigation, with trial currently set for later this year (September 2025), with attorney Jessica Teevan appointed to the Plaintiffs’ Steering Committee for that litigation.

Understanding the Cause of the Marshall Fire

On December 30, 2021, the Marshall Fire burned through Boulder County. More than 1,000 homes and commercial buildings were damaged or destroyed, and approximately 6,000 acres of land were burned, in this tragic but preventable disaster.  According to the Boulder County Sherriff’s office, discharges from power company Xcel Energy Inc.’s powerlines were the most likely cause of the Marshall Mesa Trailhead fire, which merged with another fire called the “Twelve Tribes Fire” to form the larger, faster-moving Marshall Fire. Our investigation leads us to conclude that Xcel Energy failed to take appropriate action to prevent this devastating fire and we are holding Xcel Energy accountable in court on behalf of our fire victim clients.
Case Status
The Marshall Fire cases are consolidated with the lead case, Kupfner, et al. v. Xcel Energy, Inc., et al., Case No. 2022CV30195, in front of Judge Christopher C. Zenisek in the District Court of Boulder County.Fox Fore Attorneys are on the Plaintiffs’ Steering Committee for the individual plaintiffs.
